1. Subject Matter & Operator

These Terms of Service govern access to and use of our Instagram assistant and content management platform (the "Service"), operated by:

By accessing our website, joining our waitlist, or connecting an Instagram account, you agree to these Terms in full.

2. Eligibility and Account Requirements

To use this Service, you must:

  • Be at least 18 years old (or the legal age of majority in your jurisdiction) and possess legal capacity to enter into binding agreements.
  • Have authority to bind any business or legal entity on whose behalf you use the Service.
  • Hold an active Instagram Professional Account (Business or Creator) connected in compliance with official Meta platform requirements.

3. Technical Dependency on Meta Platforms

The Service interacts with Instagram via the official Instagram API (Instagram API with Instagram Login). You acknowledge and agree that:

  • Features are subject to Meta Platform Terms, Developer Policies, and API availability.
  • You must comply with Meta's Community Guidelines and Platform Terms at all times.
  • Policy shifts or outages by Meta Platforms Ireland Ltd. may temporarily or permanently impact features beyond our control.

4. AI-Assisted Content and Editorial Responsibility

Our platform uses artificial intelligence to research topics, structure carousels, and prepare graphic layouts:

  • User Ownership: You retain full ownership and intellectual property rights in your branded assets and published posts.
  • Editorial Oversight: AI suggestions are assistive. You remain the sole publisher and are responsible for reviewing, fact-checking, and approving final publications on your account.
  • Third-Party Rights: You warrant that your published content does not infringe copyright, trademarks, privacy, or publicity rights of third parties.

5. Prohibited Uses & Anti-Spam Policy

You may not use the Service for:

  • Unsolicited commercial messages (SPAM), phishing campaigns, fraudulent schemes, or deceptive engagement.
  • Violations of Meta Messaging Policies, including unsolicited messaging outside permitted messaging windows.
  • Harassment, hate speech, defamation, or content violating applicable laws or Instagram Community Standards.
  • Reverse engineering, token extraction, unauthorized scraping, or intentional evasion of rate limits.
Violations may result in immediate suspension or termination of your account without refund.

6. Termination and Disconnection

You may disconnect your Instagram integration at any time through your Instagram account settings or request complete data deletion via our Data Deletion page. Upon termination, tokens are immediately revoked and eligible data is purged according to our retention policy.

7. Limitation of Liability and Governing Law

The Service is provided on an "as-is" and "as-available" basis. To the maximum extent permitted by applicable law, [RESPONSABLE LEGAL] shall not be liable for indirect damages, lost profits, or disruptions caused by third-party platform changes. These Terms are governed by Spanish law and the courts of Spain.
